1. Service and operator

Massay Photo, with Luis Torres as its legal representative and sole owner, operates 0101PIX from Miami Beach, Florida, United States.

Address: 7251 Wayne Ave, Apt 49, Miami Beach, FL 33141, United States.

0101PIX provides tools for professionals and businesses that organize photos and videos, share galleries, and coordinate events through 0101Live. Available features depend on the product and plan purchased.

Support: massayphoto@gmail.com.

2. Account and access

You must provide accurate information, have the legal capacity to enter into a contract, and, if acting for a business, be authorized to represent it. You are responsible for protecting your credentials and for the permissions you grant to your team.

Signing in with Google, when enabled, verifies your identity; it does not replace choosing or purchasing a plan. A matching email address alone does not authorize linking existing accounts.

3. Plans, limits, and benefits

The plan, price, currency, billing cycle, limits, and service terms will be shown before you subscribe. Storage and event limits apply to each account and product; a purchased allowance does not necessarily equal actual usage.

0101PIX may provide free plans for internal use, promotions, or partnership agreements. Their identification, capacity, validity period, and usage are retained for service administration; their commercial value does not represent a payment received. Any advertising consideration must be documented in a separate agreement.

Free trials or discounts apply only when expressly stated in the accepted offer. A feature announced for the future is not part of the available service until it is enabled.

4. Billing, renewal, and cancellation

Financial terms must be available before a subscription is confirmed. Changes to prices or terms will be communicated in accordance with the contract and applicable law.

Proposal for review: allow renewal to be canceled before the next charge and retain access until the paid period ends. Confirm whether renewal is automatic, the effective cancellation method, taxes, and annual renewal notices. This does not assert that these features have already been implemented.

Refunds: the commercial policy and its exceptions remain to be defined. A blanket prohibition on refunds will not be included, and mandatory consumer rights will not be restricted.

5. Your files and the permissions we need

You retain the rights you hold in uploaded content. To provide the service, you authorize 0101PIX to host it, process it, generate the versions needed to display it, and transmit it to the recipients you specify. This authorization is limited to operating the service and meeting applicable obligations.

You must hold the copyright, image permissions, and other authorizations needed to upload and share content. Uploading an image does not authorize 0101PIX to use it in advertising or to train AI models.

The gallery owner controls its recipients and available options. Share links carefully: recipients may retain files they have already downloaded.

6. Selections, editing, and delivery

Favorites and selections help coordinate work between the professional and the client; they do not by themselves constitute delivery of edited photographs. Edits may be uploaded manually and associated with the corresponding project.

Tracking records delivery when it is recorded that a link to the available photos was shared with or sent to the client. That record does not guarantee that the recipient opened the link or downloaded the content.

Batch AI editing is not yet offered as an active feature. If it is enabled, its scope, provider, data processing, and terms must be disclosed before use. Automated tools do not replace professional review.

7. Permitted use and user responsibilities

Do not use the service to distribute illegal content, infringe third-party rights, access other accounts without authorization, bypass limits or safeguards, introduce malicious software, or disrupt the platform.

The parties to your agreements with clients are responsible for photography, editing, permissions, and delivery arrangements. Keep copies of files essential to your business and review download options before closing an account.

8. Availability and changes

Operation may be affected by maintenance, incidents, internet connectivity, or external services. This document does not offer uninterrupted availability or any recovery guarantee that has not been expressly contracted.

Changes that materially affect a purchased service must be handled in accordance with the accepted terms and applicable rights. Future features must not be interpreted as commitments to immediate availability.

9. Suspension and closure

We may restrict access when necessary to address a breach, a legal obligation, or a security risk, aiming to keep the action proportionate. Notices, review options, and financial consequences will depend on the reason and applicable law.

Pending approval and implementation: the period for downloading files after cancellation, handling of balances, deletion timeframes, and the procedure for recovering or closing an account.

10. Privacy

The processing of personal information is described in the Privacy Policy. Sharing galleries or adding team members requires considering the permissions and privacy of the people involved.

11. Questions and dispute resolution

Report any problem to massayphoto@gmail.com so we can try to resolve it. These terms do not exclude rights that cannot be waived under applicable law.

Review the governing law and jurisdiction in light of operations in Miami Beach, Florida, United States. This draft does not propose mandatory arbitration or a class-action waiver.
